Cyprus residence permit refused, a closed office door and an empty chair

Cyprus residence permit refused is the outcome nobody plans for, and the first useful thing to know is that it moves your case out of paperwork and into law. The second is that most refusals we see were predictable from the file before it went in.

Cyprus residence permit refused: why files are refused

In our experience it is rarely a judgment call. It is usually that the facts did not meet a stated condition and the application was made anyway:

  • Income below what the route requires. The visitor permit wants remittances of about EUR 2,000 a month; the digital nomad permit wants EUR 3,500 net; the investor route wants EUR 50,000 a year plus EUR 15,000 for a spouse and EUR 10,000 per minor child.
  • Money that did not arrive the way the regulation describes. On the investor route the funds must come from abroad, from your own or your spouse's account, into the seller's Cyprus bank account.
  • Income from the wrong place. On the new-build housing category the income must be foreign and is proved only by the tax return of your country of tax residence.
  • Economic activity on a permit that forbids it. The visitor permit bars work in Cyprus.
  • A criminal record certificate, apostille or certified translation missing or expired.

The part we will not pretend about

Nobody can tell you how likely a refusal is. The Migration Department publishes no refusal rates by route and none by representative, so any agency quoting an approval rate is quoting its own unaudited number, shaped mostly by which cases it declined to take. We do not quote one either.

What happens next

Challenging a refusal is an administrative law matter. It needs a Cypriot lawyer who does immigration litigation, because it is representation rather than document preparation, and there are deadlines attached to it that start running from the decision.

That is not a fee we take. When a client comes to us after a refusal, the first conversation is about whether they need a lawyer, and often they do.

The other route, which is usually better

Re-applying on a different route, where the facts actually fit. Someone refused a visitor permit on income may qualify comfortably as a digital nomad at EUR 3,500 net a month. Someone whose investor file failed on the source of funds may be a straightforward Category F case on income from abroad.

The question that decides it is what has changed since the first application. If nothing has, a second file on the same route is the same file.

How to not be here

Read the route's own conditions before paying anything, from the Migration Department's pages rather than from an agent's summary. Where the numbers do not fit, say so early. A quote that arrives without anyone having looked at your income evidence is a quote for submitting a file, not for getting a permit.

The routes and their deciding authority are set out on the Migration Department's immigration permits page.

Common questions

Can a Cyprus residence permit refusal be challenged?
Challenging an administrative decision is legal representation, not document preparation. It belongs with a Cypriot lawyer who does immigration litigation, and we say so rather than take a fee for it.
How common are refusals?
We do not know and neither does anyone quoting a figure at you. The Migration Department does not publish refusal rates per route or per representative.
Can I just apply again?
Sometimes, and on a different route more often than on the same one. What changed since the first application is the question that decides it.

Not sure which permit fits you?

Cyprus law has several residence permit types, and each one has its own conditions and renewal rules. Send us your nationality and how you earn. We reply with the permit that fits, or we tell you if none of them does.
